Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Repackd platform ("Service") operated by Repackd Ltd ("Repackd", "we", "us"), registered in England and Wales. By creating an account or using the Service, you agree to these Terms.

If you're using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Service

Repackd provides a software platform for UK packaging compliance, including:

• Packaging data management and DEFRA RPD report generation
• Recyclability Assessment Methodology (RAM) assessments
• Fee modulation analysis and optimisation recommendations
• AI-powered document extraction and CSV column mapping
• Supplier portal for third-party data collection
• Compliance monitoring, deadline tracking, and email notifications

3. Accounts

You must provide accurate information when creating an account. You're responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at support@repackd.com if you suspect unauthorised access.

4. Your data

You own your data. All packaging data, supplier information, documents, and reports you create or upload remain your intellectual property. We claim no ownership over your content.

You grant us a limited licence to process your data solely to provide the Service. This includes running RAM assessments, generating reports, and sending notifications you've configured.

You can export all your data at any time via the dashboard. If you close your account, we'll provide a full data export on request and delete your data within 30 days (except where retention is required by law).

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious files or content designed to exploit the AI extraction features
• Share account credentials with unauthorised users
• Scrape or systematically download data from the Service beyond your own organisation's data

6. Pricing and payment

Free trial

New accounts receive a 14-day free trial with full access to all features of the selected plan. No credit card is required to start the trial.

Subscriptions

After the trial, continued access requires a paid subscription. Prices are listed on our pricing page in GBP and exclude VAT. We offer monthly and annual billing — annual plans include a discount.

Changes

We may adjust pricing with 30 days' notice. Price changes won't affect your current billing period. You can downgrade or cancel before the new pricing takes effect.

Refunds

Annual subscriptions are refundable pro-rata within the first 30 days. Monthly subscriptions can be cancelled at any time and will remain active until the end of the billing period. We don't offer refunds for partial months.

7. Compliance disclaimer

Repackd is a compliance tool, not a compliance guarantee. While we strive for accuracy in our RAM assessments, fee calculations, and DEFRA report formatting, we are not a substitute for professional compliance advice. You are ultimately responsible for the accuracy of data you submit to DEFRA and other regulatory bodies.

Our RAM assessments follow the methodology published by DEFRA and OPRL. Where the methodology is ambiguous or subject to interpretation, we apply reasonable professional judgement. Our fee calculations are based on published base rates and modulation factors, which may change when DEFRA updates official schedules.

8. Service availability

We target 99.9% uptime for the platform. We will provide reasonable notice of planned maintenance. We're not liable for downtime caused by factors outside our control (hosting provider outages, internet disruptions, force majeure events).

9. Intellectual property

The Repackd platform, including its design, code, RAM assessment logic, and fee calculation engine, is our intellectual property. These Terms don't grant you any rights to our IP beyond the right to use the Service as intended.

10. Limitation of liability

To the maximum extent permitted by law:

• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, regulatory fines, or data loss
• We are not liable for penalties or enforcement actions resulting from data you submitted to regulatory bodies using our reports

Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by English law.

11. Termination

You can cancel your subscription and close your account at any time from the dashboard Settings page. We may suspend or terminate your account if you materially breach these Terms (after giving you reasonable notice and an opportunity to remedy, except in cases of serious misconduct).

12. Changes to Terms

We may update these Terms from time to time. We'll notify you by email of material changes at least 14 days before they take effect. Continued use after the effective date constitutes acceptance. If you disagree with changes, you may close your account before the effective date.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
